1. Terms and Conditions for triathlon.org

Triathlon.org (“the Site”) is part of the International Triathlon Union (“ITU”) which operates and manages this sector. By using this site you (“the User”) agree to be legally bound by these terms and conditions. If you do not agree to be legally bound by all the following terms you should not access and/or use triathlon.org.

ITU reserves the right to change these terms from time to time. By continuing to use the site after changes are posted you agree to be legally bound by these terms as updated and/or amended.

2. Use of Content

All copyright and all other intellectual property rights in all text e.g.(press releases, datasheets, stats etc), images e.g.(photographs, graphics, logos, service marks, video etc), sound, webcasts and other materials (“the Content”) on the pages of the Site are owned by ITU and affiliated organisations or are reproduced on the Site with permission of the relevant rights owner.

The contents of the Site may not be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without ITU’s prior written consent, except as stated below:

You may read, view, print and download the contents of an individual page for private and personal non-commercial use only provided that all copyright, trademark and other proprietary notices contained in the original materials on any copy of these materials is retained, but you may not make more than one copy electronically or otherwise of any of the contents and you may not recopy or further distribute, sell, publish or transmit any part of the material by electronic or any other means.

You agree not to sell, resell, supply or otherwise make the Content or extracts or other information derived therefrom available in any manner or on any media to any third party without the prior written consent of ITU.

You acknowledge that “ITU”, “triathlon.org”, “Dextro Energy Triathlon ITU World Championship Series” are trade marks which are owned by the ITU.
You agree not to use the Site for any purpose that is unlawful. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site or its associated services. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

3. Disclaimers/Limitation of Liability

Triathlon.org content, is provided on a “AS IS” and on an “AS AVAILABLE” basis without any representations or any kind of warranty whether express, implied or statutory of merchantability, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

ITU will not be liable for any damages, including indirect or consequential damages, or any damages arising from use or loss of use, interruption of business, loss of data or profits, whether in contract, negligence or other tortious action, arising from or in connection with the use of triathlon.org

ITU does not warrant that functions contained in triathlon.org content will be uninterrupted or error free, that defects will be corrected, or that triathlon.org or the server that makes it available are free of viruses or bugs.

4. Use of Site, Services and Content

You shall pay all costs and charges, including phone charges and telecommunications equipment costs, that you incur in order to access or use the Site, Services and Content. You must adhere to all limitations on dissemination, usage and reproduction of any Content that you download from the Site that are subject to such limitations. You agree to use the Services only to access, download, utilize, post, send or receive Content in an appropriate manner as related to the particular Content or Services being accessed or used by you.
If you are required to establish an account / provide information in connection with a particular Service or Content, you must complete the designated registration process for such Service or Content. All required registration information that you provide must be current, complete and accurate and kept up to date on a prompt, timely basis. If required, you must also choose a user name and password for such account. It is your sole responsibility to keep your account number, user name, password and other sensitive information confidential.
Content and Services provided by third parties (collectively, the “Third-Party Services”) are governed by separate agreements accompanying such Content and Services. ITU offers no guarantees and assumes no responsibility or liability of any type with respect to the Third-Party Services, including any liability resulting from incompatibility between a Third-Party Service, ITU Content, ITU provided Services or another Third-Party Service. You agree that you will not hold ITU responsible or liable with respect to the Third-Party Services.

5. User account, Password and Security

The User is entirely responsible for maintaining the confidentiality of the User’s password and account, and for any and all activities which occur under the User’s account or password. The User agrees to immediately notify ITU of any unauthorized use of the User’s account, password, or any other breach of security known to the User. ITU will not be liable for any loss that the User may incur as a result of someone else using or accessing the User’s password or account, either with or without the User’s knowledge. However the User may be held liable for losses incurred by ITU or any other party as a result of someone else using or accessing the User’s password or account. The User will not use anyone else’s account at any time without the permission of the account holder. The User may change his/her password or profile by following instructions on the Site.

6. Privacy Policy

ITU will use and protect your data, such as your name and address, in accordance with the ITU Online Privacy Policy, the contents of which are incorporated by reference into the Terms of Use. Please be aware that your browser must be enabled to accept cookies in order for you to use certain Content and Services or to purchase from the ITU online store. The Privacy Policy Statement does not apply to Third Party Sites.

7. RSS feeds

RSS feeds of triathlon.org content are provided free of charge to individuals for personal and non-commercial use only. Use of triathlon.org RSS feeds for commercial purposes or by non-profit organizations will require the prior agreement of triathlon.org and you must first contact the Online Services Producer. By downloading a triathlon.org RSS feed, you acknowledge that triathlon.org does not accept any liability for its RSS feeds, and that triathlon.org is not responsible for the content of external Internet sites.

8. Webcasts

Triathlon.org/tv is a service are provided by the firm SPORTFIVE GmbH & Co. KG with headquarters in Hamburg (HRA 106925) (hereinafter “Sportfive” referred). This service is subject to terms and conditions of Sportfive and available at http://www.triathlonlive.tv/content/aboutus/203.
Triathlon.org/live is a service provided free of charge to individuals for personal and non-commercial use only by ITU. Use of triathlon.org webcast for commercial purposes or by non-profit organizations will require the prior agreement of triathlon.org and you must first contact the Online Services Producer. By connecting to a webcast, you acknowledge that triathlon.org does not accept any liability for this service, and that triathlon.org is not responsible for the content of external Internet sites.

9. Third Party Sites/Links

ITU is not responsible for the availability or content of any third party websites or material accessed through the triathlon.org site. ITU does not exercise any control or supervision of content of these linked sites.

Triathlon.org does not endorse, and shall not be held responsible for any content, advertising, products, services or information on or available from third party sites. Third party sites linked through triathlon.org are not covered by these terms and conditions.

10. General

If any provisions of these terms and conditions are found to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect.
The section titles in the document are solely used for the convenience of the parties and have no legal or contractual significance.
These terms shall be governed by and interpreted in accordance with the laws of Canada.
